CONDITIONS OF RENTAL

  • All vehicles are rented subject to Karo Car Hire’s (“KCH”) standard terms & conditions of the rental agreement, which must be signed by all renters. The site is for information purposes only.

AVAILABILITY

  • Certain groups and/or models may not be available at a particular time. All models are subject to availability.

MINIMUM RENTAL CHARGE

  • The minimum rental period is two days.

RATES & RENTAL CHARGES

  • Rates are quoted in South African Rand (ZAR).
  • Rates, conditions and information are subject to change without prior notice.
  • Rates include maintenance, oil, VAT, tourism levy, but exclude fuel.
  • The renter agrees to pay KCH  the rental rates plus all other charges and fees opted for or utilized by the renter as contemplated in the Billing Form and up until the vehicle is returned

USE OF THE VEHICLE

  • The vehicle may be used for the rental period.
  • During the rented period, the vehicle may not be used for any of the below:
    • Conveyance of passengers or goods for reward.
    • Towing of any other vehicle (including caravan or trailer without written consent of KCH)
    • Transport goods in violation of any custom laws or any illegal manner.
    • Make use of the vehicle for any motor sport or high risk activity
  • The vehicle will not be taken outside the borders of South Africa or in any area that might pose a risk of incidents or civil unrest
  • The renter shall make adequate provision for the safety and security of the vehicle at all times and shall keep the vehicle locked and immobilized.
  • The renter shall be liable for the damage or loss of the radio if the removable face radio was not removed
  • The keys shall be under the renters control at all times
  • The vehicle remains the property of KCH at all times.

RENTAL REQUIREMENTS

  • The client would be required to supply the following.
  • Credit card
  • Name, address, telephone number and email address
  • Local contact details
  • Driver’s license, passport or ID

FORMS OF PAYMENT

  • Rentals will only be granted to holders of an approved major credit card i.e. American express, Master or Visa.
  • Authorization will be obtained at time of rental.
  •  Full rental amount will be deducted on the commencement day of your rental.
  • Payments are due on demand, but at latest on expiry of the rental period (unless otherwise agreed in writing)
  • No payment will be allowed to be set-ff or withheld for any reason whatsoever

DELIVERY AND COLLECTION TIMES

  • Normal working hours on week days. Mondays to Fridays, 08:00 am to 17:00 pm. Saturdays from 09:00 am to 13:00 pm.
  • After hours (Sundays, Public holidays and all times not specified under normal working hours above)
  •  After hour deliveries and collections will attract a fee of R280.00.
  • Deliveries outside of Cape Town will attract a fee determined by distance measured in kilometres.

EXTENSION OF RENTAL

  • Extension of rental beyond the original date must be authorised by KCH.
  • Failure to comply with this procedure will result in the renter driving the vehicle without collision damage waiver and/or theft protection and without lawful permission.
  • If extension is required, please contact KCH at least 24 hours before the end of the rental contract.

CANCELLATION FEE

  • Rentals which are not cancelled in a minimum of 24 hours before the rental commence are subject to a R500 cancellation fee.

HANDLING FEES

  • All fines and penalties incurred during the rental period are for the renters own account.
  • In addition a R200 handling fee will be levied on traffic penalties incurred.
  • Loss of keys will result in an applicable replacement charge being levied.
  •  A valet charge of R450 will be levied if the vehicle is returned in an exceptionally dirty condition.
  • If there is loss of or damage to the vehicle, a claim handling fee of R450 will be charged on termination of the rental.
  • In determining the rental charges, the distance travelled by the vehicle (where required) shall be determined from the vehicle odometer, or if this is not possible for any reason, by the company in it’s sole discretion, on any other fair and reasonable basis and the renter shall be obliged to furnish all such information and assistance as the company may reasonably require for that purpose.
  • If the odometer has been tampered with, then the kilometres travelled will be deemed to be 500 kilometres per day.
  • Call out fees will be charged at R300 per call out (i.e. flat tyre, lost keys, etc.)

DEPOSITS, EXCESS AND FUEL

  • Each rented vehicle leaves with a full tank and the renter pays for refuelling on return.
  • Each vehicle is refuelled on termination regardless of whether or not the fuel gauge indicated that the vehicle is full.
  • A deposit for fuel of R500 is required on initiation of the rental.
  • Own damage basic excess is R5 000.
  • Vehicle driven by person under age of 26 and who has held a licence for less than 5 years will be liable for the full excess as well as 5% of the claim.
  • The Theft / Hi-jacking excess amount will be 15% of the claim.
  • Windscreen damage is for the renters account.

ADDED EXTRAS

  • Additional drivers are charged at R120 per rental per driver.
  • Child seats are charged at R85 per day, per seat, for children of age 0-5 years. For long term hire, the price will be negotiated by Karo Car Hire’s director.

RENTER RESPONSIBILITIES

  • The renter warrants that he/she in entitled to enter into the legal agreement and that all particulars given to KCH are deemed to be true and correct.
  • The vehicle may only be driven by the driver’s particulars given to KCH.
  • Drivers must be in possession of a valid driver’s license for at least 2 years.
  • While driving, drivers are required to have their drivers license in their possession at all times.
  • The renter will not allow anyone to drive the vehicle whose blood alcohol concentration exceeds the limit by law.
  • If the vehicle is driven by anyone else than the specified drivers, the renter will still take full responsibility for any damages as if he/she was driving the vehicle.

EXCLUSIONS

  • The renter will be liable for the full value of the damage and or loss where such damage or loss is sustained in circumstances including but not limited to the following;
    • As a result of driver negligence.
    • Where the vehicle is driven by an unauthorised driver i.e. a driver not specified as a driver in the rental agreement.
    • Driving under the influence of alcohol or any illegal substances.
    • Failure to obtain authorization from KCH agents to extend the pre-booked rental.
    • Where accidents are not reported within 24 hours to the nearest police station or to the rental company within 6 hours.
    • Where the vehicle has been taken beyond the borders of South Africa without the prior written permission of the rental company.
    • Not being able to produce the keys in case of theft unless exceptional circumstances apply.
    • Not reporting the exact details of the last known location of the vehicle prior to the theft.
    • Collisions where no other vehicle, person, animal or object is involved.
    • Where there has been a material breach of the Terms & Conditions of the rental agreement.
    • Not adhering to the traffic, road and driving rules and regulations.
    • Unsuitable driving or road conditions.
    • Acceptance of insurance does not cover the renter for damage to or loss of tyres, rims and hubcaps, for damage to windscreens, for water and under carriage damage or for towing damages.

PERSONAL BELONGINGS/INDEMNITY OF COMPANY BY RENTER

  • Personal belongings are not covered by the insurance provided.
  • Karo Car Hire is not responsible for any loss/damage of personal belongings.
  • Neither the company nor any of its directors or employees or agents shall be held liable for any loss or damage (including any loss or damage to property left or transported in the vehicle, any loss of life or any loss or damage arising from the installation or condition of a child seat or any other accessory in and/or on the vehicle), whether direct, indirect, consequential or otherwise arising from the rental by the renter of the vehicle, including, without, limitation, any defect in and/or mechanical failure of the vehicle (howsoever arising and of whatever nature) or the failure of the Company to detect defects in or mechanical problems with the vehicle and whether such loss or damage results from breach of contract or delict, (including negligence or gross negligence) or otherwise which may be suffered by the renter and/or any third party and/or passenger.
  • The Company, its directors, employees, servants or agents are accordingly indemnified by the renter or his estate against any claim of any nature whatsoever and howsoever arising from any damages or loss which might be instituted against them arising from or connected with or pursuant to the renting of the vehicle contemplating in these terms and conditions.

PROCEDURE IN THE EVENT OF BREAKDOWN / ACCIDENT / THEFT
What to do in a case of a breakdown;

  • Contact Karo Car Hire immediately
  • Emergency SOS telephones are conveniently located on most highways.
  • Client is not to replace or repair any vehicle parts unless authorised by Karo Car Hire.

What to do in event of accident/theft

    • Contact Karo Car Hire immediately
    • A full report must be made to the nearest Police Station within 24 hours in the event of an accident. In the case of theft, a full police report must be made within 6 hours from the time the theft was identified.
    • He/she shall obtain all names & addresses of everyone who was involved in the accident, as well as witnesses.
    • He/she shall co-operate with the Company and its insurer in the investigation, the making or instituting of any claim or action and the defence of any prosecution, claim or action relating to the incident. (Including the signing of an affidavit if he/she is required to do so.)
    • A case number must be obtained from the SA Police Services.



    E-COMMERCE & PRIVACY

    The Website karo-carhire.co.za sells car hire services online.  The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website. 

    The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.  Credit card details are not kept by the Provider under any circumstances.

    The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

    The Provider will supply all goods to the delivery company in good order. The Provider will not be held liable for the condition of goods arriving at the User’s chosen delivery address.

    Online Payment – MyGate Payment Gateway

    All online credit card payments are processed by the MyGate Internet Payment Gateway.  Card Holders may go to www.mygate.co.za to view MyGate security policy.
